1. Acceptance of Terms
By creating an account, accessing, or using StreamHCM (the “Service”), you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use the Service. These Terms apply to all users, including administrators, employees, and any other persons accessing the platform.
2. Description of Service
StreamHCM is a cloud-based Human Resource Management System (HRMS) covering organization and employee management, biometric and GPS attendance, shift and leave management, payroll and EOBI/tax processing, performance and task management, recruitment (ATS), an employee self-service portal, a manager portal, and reporting/analytics. The Service is provided on a subscription basis to businesses and organisations (“Clients”), and is multi-tenant, each Client's data is logically isolated from other Clients.
3. Accounts & Registration
To use the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account. You must notify us immediately at hello@streamhcm.com if you suspect unauthorised access.
You must be at least 18 years old and legally authorised to enter into contracts on behalf of your organisation to create an account.
4. Subscription & Payments
Subscription fees are billed in PKR on a monthly or annual basis as selected at signup. All fees are non-refundable unless otherwise stated. StreamHCM reserves the right to modify pricing with 30 days' written notice. Failure to pay may result in suspension or termination of your account.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Upload or transmit malicious code, viruses, or harmful content.
- Attempt to gain unauthorised access to any part of the Service.
- Reverse-engineer, decompile, or disassemble the software.
- Resell or sublicense the Service without written permission.
- Use the Service to harass, abuse, or harm any person.
6. Data, Biometrics & Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated by reference. As between StreamHCM and the Client, the Client is the data controller for employee data entered into the platform (including biometric data), and StreamHCM acts as a data processor, handling data only on the Client's instructions.
Where a Client enables biometric attendance (face recognition or fingerprint devices), the Client is solely responsible for obtaining any consent or notices required from its employees under applicable law before enrolling their biometric data.
7. Intellectual Property
StreamHCM and its licensors own all intellectual property rights in the Service, including software, designs, logos, and documentation. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription period.
8. Disclaimers & Limitation of Liability
The Service is provided “as is” without warranties of any kind, express or implied. StreamHCM does not warrant that the Service will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, StreamHCM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
9. Termination
Either party may terminate the subscription with 30 days' written notice. StreamHCM may suspend or terminate your account immediately for breach of these Terms. Upon termination, you must cease using the Service and we will provide a 30-day window to export your data.
10. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Pakistan. Any disputes arising under these Terms shall be resolved exclusively in the courts of Lahore, Pakistan.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the platform at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
